Welcome to Heirloom. These Terms of Service (the “Terms”) are the agreement between you (“you” or the “customer”) and Heirloom Revived (“Heirloom,” “we,” “us,” or “our”) for our photo-restoration service. By placing an order or uploading a photo, you agree to these Terms. If you do not agree, please do not use the service.

1. What we do

Heirloom is a done-for-you service. You upload an old, damaged, faded, torn, or black-and-white family photo, and our team restores it — and, if you choose, adds color — then returns a high-resolution digital file to you. You do not need to install or use any software; we do the work for you. Our typical turnaround is about 24–48 hours after we receive a usable photo and payment.

2. How restoration works (AI-assisted, and what that means)

We restore and colorize photos using a combination of skilled human review and artificial-intelligence tools, which may include Google Gemini and/or similar third-party AI services. Because of this, please understand:

3. Ordering and payment

Current pricing is shown at checkout. As a general guide: a single photo is $9; bundles are available up to 10 photos for $59; optional add-ons such as colorization or rush handling are +$5 each. Prices, bundles, and add-ons may change, and the price shown at checkout applies to your order.

4. Turnaround times are targets, not guarantees

Our stated turnaround (about 24–48 hours, or faster if you purchase rush handling) is a good-faith goal, not a binding promise or a guarantee of delivery by a specific time. Actual timing can vary with order volume, photo condition and complexity, holidays, and factors outside our control, including the availability of the third-party AI tools we use. A delay in delivery is not, by itself, a basis for damages beyond the remedies described in our Refund & Satisfaction Guarantee.

5. Revisions

We want you to love the result. If something looks off, tell us. Each order includes [NUMBER] complimentary revision(s) on the same photo, provided you request changes within [NUMBER] days of delivery and the request relates to the original restoration (for example, adjusting color tone or a corrected area). Requests that go beyond the original scope — such as restoring a different photo, adding or removing people or objects, or new creative directions — may be treated as a new paid order. Revision availability does not extend the deadlines in the Refund & Satisfaction Guarantee.

6. Your photos: your rights and responsibilities

This section is important. By uploading any photo or other image to Heirloom, you represent and warrant that:

You are solely responsible for the images you submit. If a third party claims a right in a photo you submitted, that is your responsibility, not ours (see “Indemnification” below). Please also see our separate Photo Rights & Consent policy for more detail on rights and on how before/after examples are handled.

7. Acceptable use and prohibited content

You agree to use Heirloom only for lawful, personal, family, and similar legitimate purposes. You agree not to submit any image that:

We may refuse, pause, or cancel any order, and remove any content, that we reasonably believe violates these Terms or the law. Where an order is cancelled because content is prohibited, we may withhold a refund for work already performed as permitted by law.

8. Delivery, files, and keeping copies

We deliver the finished restoration as a digital file (for example, by download link or email). You are responsible for downloading and saving your file promptly and for keeping your own backup. Because we delete photos on the schedule described in our Privacy Policy, we may be unable to re-send a file after that deletion window.

9. Intellectual property

You keep all rights you have in your original photo. When your order is fully paid, you are free to use the restored file for your personal and family purposes. Heirloom retains ownership of its own branding, website, and systems. We do not claim ownership of your photos, and we will not use them for marketing unless you give the explicit opt-in consent described in the Photo Rights & Consent policy.

10. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties we have not expressly made in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that results will meet a particular artistic expectation, that delivery will occur by a specific time, or that the service will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, Heirloom and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of a photo, or lost profits, arising out of or relating to the service or these Terms, even if we were advised such damages were possible. Our total liability for any claim relating to an order will not exceed the amount you actually paid us for that order. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Heirloom and its owners, employees, and contractors from and against any claims, damages, losses, liabilities, and reasonable legal costs arising out of or related to: (a) an image you submitted; (b) your breach of these Terms or your representations and warranties, including the rights and consent representations above; or (c) your violation of any law or third-party right.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Effective date” above and post the updated Terms on our website. Your continued use of the service after an update means you accept the revised Terms. Orders are governed by the Terms in effect when the order was placed.

14. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. You agree that the state and federal courts located in [STATE] (or another venue we agree to in writing) will handle any dispute, unless applicable law requires otherwise.
